Developer WPD has filed a complaint with Germany’s Federal Constitutional Court against the country’s offshore wind energy law (WindSeeG), which excludes the company’s 580MW Kaikas project in the German North Sea from future tenders without compensation.
The project, which would be located some 110km off the German coast, was approved with 80 turbines by the Federal Maritime and Hydrographic Agency in 2013.
Kaikas is the only approved offshore wind project to be excluded from future tenders under the WindSeeG, which entered into force on 1 January, WPD said.
In the 150-page constitutional complaint, WPD argues that the provision constitutes a violation of the principle of equality, as well as the freedom to work and the freedom of ownership.
The complaint is authored by Marcus Dannecker from the law firm Gleiss Lutz.
WPD executive Achim Berge Olsen said: “In order to meet governmental requirements, we have invested a significant double-digit million figure, and then, just before implementation, we lost all options for realisation.
“Investors cannot be treated worse, and investment security cannot be more clearly undermined.”
