CS Wind has failed in a bid to overturn an interim order preventing it removing equipment from the Machrihanish turbine tower manufacturing facility near Campbeltown, Scotland.
Judges at Scotland’s court of session threw company’s appeal out, adding that they were surprised leave to appeal had been granted for the interim interdict, which is similar to an injunction elsewhere in the UK.
CS Wind’s lawyers had challenged whether Highlands and Islands Enterprise had a sufficiently strong prima facie case that removal of plant would breach undertakings made by the tower manufacturer to receive a £2.8m development grant.
HIE, the ultimate owner of the site, secured the order in March to stop equipment being removed from the mothballed factory and said it was pleased with the court’s decision.
The interim interdict, granted by a commercial judge, will now remain in place until the dispute is fully resolved through the commercial courts.
CS Wind’s attempt to overturn the interim interdict was first reported in a subscriber-only issue of reNEWS at the start of this month.
Earlier this month union representatives and local politicians wrote an open letter to the South Korean-owned company seeking clarification of its plans for the site.
