Global law firm Dentons has advised PowerChina Guizhou on the implementation of the Progressovka project, a 148MW solar power plant in the Mykolaiv region of Ukraine.
The project is being implemented jointly with the Norwegian energy company Scatec Solar, as equity investor, while PowerChina Guizhou is providing financing and engineering procurement and construction (EPC) services to the project.
After construction, the solar plant will produce 187GWh a year, providing clean energy for 76,000 households and reducing annual carbon emissions by 150,000 tonnes.
The commercial operations of the plant are expected to commence in the first half of 2020.
The project will be implemented under Ukraine’s 10-year feed-in-tariff scheme, but the solar plant is expected to deliver power beyond the feed-in-tariff period.
Dentons provided legal support under English and Ukrainian law, on the supply contract, EPC contract (based on the FIDIC form), loan agreement, umbrella agreement, as well as security documents.
Dentons’ cross-border team was led by partner Adam Mycyk and counsel Maksym Sysoiev, and included partner Natalia Selyakova, counsel Nadiya Shylienkova, and associate Nadiya Levchuk, Artem Lukyanov and Viktor Marchan in Kyiv.
Partners Ian McGrath and Tamsyn Mileham, both based in Turkey, provided English law advice.
