A Copenhagen court has ruled that energy company Elsam abused a dominant position in the wholesale electricity market in Western Denmark over an 18-month period starting in 2005.
Danish offshore wind giant Dong, which took control of the company in 2005, said it “disagrees” with the ruling and has set aside Dkr298m (€40m) to cover compensation from the case.
Dong said it is yet to decide on an appeal against today’s ruling and added that the decision does not change its 2016 outlook. The deadline for any appeal is 27 September.
“We disagree with the judgment. In the Copenhagen Maritime and Commercial High Court, we’ve shown that the total costs which the Danish competition authorities recognised that Elsam was entitled to have covered, exceed the prices charged by the company in the period investigated,” said Dong executive vice president Thomas Dalsgaard.
“We don’t believe that Elsam violated the competition rules. We will now read the reasons and decide whether to appeal the judgment,” he added.
