The government of Ontario will today seek a motion to dismiss Trillium Power’s litigation efforts with regard to a 414MW freshwater offshore project in Lake Ontario.
Trillium said it had been given notice of the motion, which is similar to one by Ontario’s government in 2013 that was overturned by the Ontario Court of Appeal.
The project was blocked in 2011 when the government slapped a moratorium on offshore wind development in the Great Lakes.
Trillium Power is seeking damages of $500m for “misfeasance”.
The government of Ontario denies the accusation.
