Welsh developer Mynydd Y Gwynt Limited has failed to save its 89.1MW wind farm in Powys.
The High Court has dismissed a judicial review challenge against former Energy Secretary Amber Rudd’s refusal of the project.
Mynydd Y Gwynt Limited argued that Rudd had misunderstood the threat to red kites when she refused the 27-turbine project against the recommendation of the Planning Inspectorate.
Mr Justice Hickinbottom made his decision to throw out the challenge based on doubts about the number of red kites that might forage on the site of Mynydd y Gwynt.
The red kite is a protected species.
It is understood that a fresh application for the site could be submitted via the Welsh government’s Developments of National Significance planning regime.
