There will be no appeal by the Danish competition authorities against a high court decision earlier this year to acquit Orsted-owned Elsam of abusing a dominant position in the wholesale electricity market in western Denmark over 18 months starting in 2005.
The Danish Appeals Permission Board today rejected a petition by the Danish competition authorities to appeal the decision, which is now final, Orsted said.
Orsted chief financial officer Marianne Wiinholt said: “We’re very pleased with the decision of the Appeals Permission Board. They’ve listened to our arguments and not granted leave to appeal the decision of the High Court of Western Denmark.
“This means that we can now hopefully bring an end to what has been a very protracted case.”
In May, Orsted, which took control of Elsam in 2005, won its own appeal against a 2016 decision by the Copenhagen Maritime and Commercial High Court that Elsam had violated Danish competition rules from 1 January 2005 to 30 June 2006.
