Lawyers representing Orsted’s 704MW Revolution Wind have described the Trump administration’s stated concerns about the project as “factually inaccurate”.
A federal court filing in Revolution Wind’s challenge to the Trump administration’s stop-work order argues that Trump administration lawyers have presented new arguments not originally mentioned in the August stop-work order.
Allegations made by government lawyers are “controverted by Revolution Wind’s compliance with Project requirements”, lawyers representing the project wrote.
Trump administration officials had claimed that Revolution Wind has not satisfied national security conditions of its Constructions and Operations Plan approval, and said that “given how long they have remained pending, the (Department of Defense) has concerns as to whether they will ever be met”.
