The UK Supreme Court has upheld planning consent for the Clashindarroch 2 onshore wind farm, marking the final ruling in a multi-year legal process.
The decision confirms the Scottish Government’s original consent for the project following a public inquiry and marks the fourth time the matter has been tested in court.
Vattenfall, the project’s developer, welcomed the outcome and said it highlights the need to streamline judicial reviews and prevent delays caused by repeated challenges.
“This is a welcome decision which completely vindicates the Scottish Government’s decision to award planning consent to Clashindarroch 2 Wind Farm,” said Matt Bacon, Vattenfall’s head of onshore wind market development UK.
“This protracted process demonstrates why changes to streamline the judicial review process and prevent vexatious challenges are so urgently needed.”
Clashindarroch 2 will expand on the operational Clashindarroch wind farm, which has been generating electricity for a decade.
Vattenfall said the project will raise annual funding for the local community to over £800,000 and support new conservation initiatives for Scottish wildcats and other species.
